MZR Remodeling - Terms of Service & Payment Policy

Effective Date: September 28, 2024

1. Introduction

These Terms and Conditions ("Terms") govern the services provided by MZR Remodeling ("MZR") to you, the customer ("Customer"). By accepting a quotation from MZR, you agree to be bound by these Terms.

2. Project Scope and Estimates

• Quotations: All quoted prices are estimates and subject to change based on final project scope.
• Revisions: One free scope revision is included. Any additional scope or project changes will incur a fee of $99 per revision.

3. Payment Terms

• Payment Schedule: 
  • 50% of the total balance is due 48 hours before the project start date.
  • The remaining balance is due within 7 days of the project completion date.
• Cash Discount: Cash discounts are offered on some projects.  Please inquire with the MZR team for details and eligibility.

4. Procurement and Installation

• Materials: Procurement of materials is the responsibility of the Customer. MZR can assist with recommendations or sourcing materials for an additional fee.
• Installation: Installation is the responsibility of MZR as quoted on the signed estimate.

5. Project Timeline

• Estimated Completion Time: Projects are estimated to be completed within a discussed timeline and will be generally outlined on the project contract. This timeline is subject to change at any time for any reason by MZR Remodeling.
• Delays: The project timeline can be changed or delayed by MZR for any reason at any time. MZR will communicate any delays to the Customer as soon as possible.

6. Cancellation and Termination

• Cancellation After Work Starts: If the project is terminated or cancelled for any reason after work has begun, the balance for the completed portion of the project is due in full immediately. The completed work and amount will be determined by MZR Remodeling.

7. Acceptance of Quotation

• Digital Signature: Signing the quotation electronically indicates your acceptance of these Terms.

8. Communication

9. Waiver of Legal Rights and Reviews

• Dispute Resolution: Customer agrees to bring any concerns or disputes regarding the project to MZR's attention in writing within 60 days of project completion. MZR will use commercially reasonable efforts to resolve the dispute amicably.
• Waiver of Legal Action and Liens: In the event a dispute cannot be resolved within 60 days, Customer waives the right to sue MZR or place a lien on MZR's property for any reason related to the project, including but not limited to breach of contract, negligence, or other claims.
• Waiver of Negative Online Reviews:  Customer agrees to refrain from posting negative online reviews about MZR's services until the 60-day dispute resolution period has passed, as outlined above.

10. Entire Agreement

These Terms constitute the entire agreement between MZR and the Customer regarding the project and supersede all prior or contemporaneous communications, representations, or agreements.

11. Governing Law

These Terms will be governed by and construed in accordance with the laws of the State of Kansas, without regard to its conflict of laws principles. 

12. Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision will be struck and the remaining provisions will remain in full force and effect. 

13. Waiver

No waiver of any breach of any provision of these Terms will be deemed a waiver of any subsequent breach.

2. Project Scope and Estimates

• Quotations: All quoted prices are estimates and subject to change based on final project scope.
• Revisions: One free scope revision is included. Any additional scope or project changes will incur a fee of $99 per revision.

3. Payment Terms

• Payment Schedule: 
  • 50% of the total balance is due upon the project reaching 50% completion. Completion is determined solely by MZR Remodeling.
  • The remaining balance is due within 10 days of the project's final completion.

4. Procurement and Installation

• Materials: Procurement of materials is the responsibility of the Client. MZR can assist with recommendations or sourcing materials for an additional fee.
• Installation: Installation is the responsibility of MZR as quoted on the signed estimate.
